Auction Terms and Conditions

Vander Kolk Auction terms and conditions:

The following are a few things that you will need to keep in mind while you are bidding at our auctions.

Our auction terms and conditions may vary from auction to auction depending on the circumstances of each event. Please see the advertisement or contact our office for event specific auction terms and conditions.

1) FULL PAYMENT

shall be made on the date of the auction before buyer leaves the premises.

2) TERMS OF AUCTION:

Payment for purchases must be made by cash, or cashiers check. All checks will be made payable to “Vander Kolk Auctions”. All sales are subject to MI sales tax laws. Bidder agrees not to stop payment on checks or charges.

3) NO WARRANTY:

The descriptions of items appearing in advertising prior to this sale are believed to be correct. Nevertheless, neither those descriptions nor the oral statements made by owner, it’s officers, agents and employees of Vander Kolk Auction Service concerning any items shall be construed as a warranty, either expressed or implied. ALL ITEMS ARE SOLD AS IS – WHERE IS and All sales are final.

4) RECEIPT:

Buyer will be furnished a receipt when payment is received for items purchased. This receipt must be presented to and validated by check-out personnel before the buyer will be permitted to remove purchases from the auction premises.

5) REMOVAL DATE:

Merchandise becomes the full responsibility of the buyer when the Auctioneer says “Sold,” and the buyer assumes all risk of loss and damage to property until removed from auction premises. All merchandise must be removed from the premises on the day of sale following payment. Nothing to be removed until settled for and accompanied by a paid receipt.

6) ANNOUNCEMENTS:

All announcements made day of sale take precedence over printed material.

7) LIST: List subject to change at any time, catalogs and sale bills are only guides to help you during the auction, they are subject to error.

8) DISPUTES BETWEEN BIDDERS:

The Auctioneer shall designate the Purchaser after each item of merchandise is auctioned. If a dispute arises between two or more bidders, the auctioneer reserves the right to reopen bidding. His designation of a buyer shall be final.

9) INJURY AND DAMAGE:

Bidder acknowledges responsibility for any personal injury or property damage caused by bidder or his agent and further agrees to hold Vander Kolk Auctions, the owner, it’s officers, or employees harmless for any personal injury to himself or his agents and any property damage incurred on sale premises.

10) DATA ENTRY AND UNPAID AUCTION BIDS:

Items purchased but not paid for are subject to penalty and invoicing with immediate payment due. Items not invoiced due to bidder checking out before all auction data is entered is subject to invoicing and 5% handling fee.

11) RETURNED CHECKS:

All returned checks are subject to a $25.00 fee.
